Terms of service

These terms are the agreement between you and TestLinkPro for using the TestLinkPro test-management service. Please read them. They're written to be readable, but they are still a binding contract.

1. Who we are

TestLinkPro is operated by Kamran Ghaffar, a sole proprietor based in Pakistan, trading as "TestLinkPro". TestLinkPro is not a registered company. Email: hello@testlinkpro.com.

In these terms, "TestLinkPro", "we", "us" and "our" mean that operator. "You" means the person or organization agreeing to these terms. The "Service" means the TestLinkPro web app at https://app.testlinkpro.com, its APIs, CI integrations and related features. Our website is https://testlinkpro.com.

TestLinkPro is an independent product and is not affiliated with the TestLink open-source project.

2. Accepting these terms

By creating an account, joining an organization, starting a trial or buying a subscription, you agree to these terms, our Privacy Policy and our Refund Policy.

If you accept these terms on behalf of a company or other organization, you confirm that you have authority to bind it, and "you" means that organization.

The Service is built for business and professional use. You must be at least 16 years old (or the age of digital consent where you live, if higher) to use it.

3. Accounts and organizations

  • Your account. You need an account to use the Service. Give accurate details and keep them up to date. You're responsible for keeping your password and API tokens safe and for everything done through your account. Tell us straight away at hello@testlinkpro.com if you think your account has been compromised.
  • Organizations. Work happens inside an organization (workspace). The person who creates an organization is its first owner. Owners and admins control who has access, what role each member has, which integrations are connected and the organization's subscription.
  • Members. If you join an organization by invitation, the organization's owners and admins control your access and the content you add to that organization belongs to that organization (see section 8).
  • Users and viewers. For plan limits and billing, a "user" is a member who can create or edit content. Read-only viewers are free and do not count towards user limits.

4. Plans, trials and pricing

  • Prices are in US dollars and exclude sales tax, VAT or GST, which Paddle adds at checkout where it applies. Paddle may show prices in your local currency.
  • Read-only viewers are free on every plan.
  • The features in each plan are described on our pricing page. If that page and these terms conflict on price or limits, the price you agreed to at checkout applies.
  • Free trial. New organizations can try the Team plan free for 14 days. No payment card is needed, so you are never charged automatically when the trial ends. If you don't buy a plan by the end of the trial, your organization moves to the Free plan (see section 7).
  • Price changes. We may change our prices. Any change applies from your next renewal, and we'll tell you by email at least 30 days before it takes effect. If you don't accept the new price, you can cancel before the renewal.

5. Payment through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

In practice this means:

  • When you buy a subscription, you are buying it from Paddle, which resells it to you. Paddle handles checkout, payment, invoices and receipts, sales tax/VAT, and refund processing.
  • Your purchase is also subject to Paddle's Buyer Terms, which you accept at checkout. These terms (ours) govern your use of the Service itself.
  • We never see or store your full card details. Paddle processes payment information under its own privacy policy.
  • Billing questions, invoices, payment method changes and refund requests can go to Paddle at paddle.net, or to us at hello@testlinkpro.com and we'll help.
  • Before you pay, checkout shows the plan, the amount, the billing interval and that the subscription renews automatically. Please check your order; if you notice a mistake, contact us or Paddle and we'll help put it right.

6. Renewals and cancellation

  • Auto-renewal. Paid plans are monthly or annual subscriptions that renew automatically for the same period at the then-current price, until cancelled. Paddle charges the payment method on file at each renewal.
  • Changing your plan or seats. If you upgrade or add users during a billing period, Paddle charges a pro-rata amount for the rest of that period. Downgrades and seat reductions take effect at your next renewal.
  • Cancelling. You can cancel at any time from the billing section of your organization settings, through the "Manage subscription" link in your Paddle receipt, at paddle.net, or by emailing hello@testlinkpro.com. Cancellation stops future renewals. Your paid plan stays active until the end of the period you've paid for.
  • Refunds. Our Refund Policy explains when you can get your money back, including our 14-day money-back guarantee.
  • Failed payments. If a renewal payment fails, Paddle may retry it. If it still can't be collected, the subscription may be cancelled and your organization moved to the Free plan.

7. Plan limits and downgrades

  • Each plan has limits (for example users, projects and test cases). If you reach a limit, you'll need to upgrade or remove something before adding more.
  • When a paid subscription or trial ends, your organization moves to the Free plan at the end of the paid period.
  • If your organization is above the Free plan limits at that point, nothing is deleted. Content above the limits becomes read-only, and you can still view and export it. You can bring the organization back within the limits, or upgrade again, to restore full editing.
  • We never delete your data automatically because of a downgrade. Data is only deleted when you delete it, when you delete your organization or account, or as described in section 15.

8. Your data

  • You own your content. "Customer Data" means everything you or your members put into the Service: projects, test cases, test runs, results, attachments, screenshots, CI test reports, comments and similar content. You (or your organization) own it. We claim no ownership over it.
  • Our licence to host it. You give us a limited, worldwide licence to host, store, copy, transmit, process and display Customer Data only as needed to run, secure, support and improve the Service for you, to follow your instructions (for example, sending data to an integration you connected), and to meet legal obligations. This licence ends when the data is deleted from our systems.
  • Your responsibilities. You're responsible for the Customer Data you add and for having the right to add it. Don't upload personal data you don't need for testing (for example, use test or masked data instead of real customer records where you can).
  • Export. You can ask for an export of your organization's data at any time by emailing hello@testlinkpro.com. Some data, such as test cases, can also be exported from within the app.
  • Privacy. Our Privacy Policy explains how we handle personal data. Where we process personal data in Customer Data for you, we act as your processor, and a Data Processing Agreement (DPA) is available on request.

9. Acceptable use

You must not use the Service, or let anyone else use it, to:

  • break any law, or infringe anyone else's rights, including intellectual property and privacy rights;
  • upload malware, or content that is illegal, harmful, or that you have no right to share;
  • send spam or unwanted messages, including through invitations, notifications or any other email feature, or invite people who haven't agreed to be contacted;
  • abuse integrations or CI ingest: for example, flooding the API or report-upload endpoints, sending data unrelated to testing, using another person's tokens or credentials, or using an integration to access third-party systems you're not authorised to use;
  • probe, scan, load-test or penetration-test the Service, or try to get around security or plan limits, without our written permission (to report a security issue, email hello@testlinkpro.com);
  • access other organizations' data, or try to break the separation between organizations;
  • copy, resell or rent the Service, or reverse engineer it except where the law allows;
  • use the Service to build a competing product, or scrape it in bulk;
  • create accounts by automated means, or create multiple free organizations to get around the Free plan limits.

We may set reasonable rate limits and storage limits to keep the Service fair and stable.

10. AI features

  • Some features use artificial intelligence (AI), for example to suggest or generate test cases. These features only run when your organization connects its own account with an AI provider (such as OpenAI, Anthropic or Google) using your own API key.
  • When you use an AI feature, the relevant content (such as your prompt and the test data you select) is sent to the AI provider you configured, under your own key and your own agreement with that provider. That provider's terms and privacy policy apply to what it does with the data. We don't control AI providers and aren't responsible for them.
  • We store your AI API keys encrypted and use them only to make the requests you trigger.
  • AI output can be wrong, incomplete or unsuitable. Review it before you rely on it. You're responsible for how you use AI output, and for any costs your AI provider charges you.
  • We do not use your Customer Data to train AI models.

11. Third-party integrations

  • You can connect the Service to tools you choose, such as Jira, Azure DevOps, GitHub, GitLab or Slack. When you do, you authorise us to exchange data with that tool on your behalf, as you've configured it.
  • We store integration credentials encrypted at rest and use them only to provide the integration.
  • Third-party tools are provided by their own vendors under their own terms. We're not responsible for them, for how they handle data, or for changes they make that affect an integration. We may change or stop supporting an integration if the third party changes its service.

12. Availability and support

  • We work hard to keep the Service available, secure and fast, but it is provided without an uptime guarantee. We don't currently offer a service level agreement (SLA) on any plan.
  • We may need to carry out maintenance. We'll try to do it at quiet times and give notice of planned downtime where we reasonably can.
  • We may improve, change or remove features over time. If we remove a major feature you're paying for, we'll tell you in advance.

13. Suspension

We may suspend access to all or part of the Service, for the organization or member involved, if:

  • you seriously or repeatedly breach these terms (including the acceptable use rules);
  • your use creates a security risk, or could harm the Service, other customers or third parties;
  • we're required to by law; or
  • a payment is disputed or reversed (a chargeback) while the dispute is looked into.

Where reasonable, we'll tell you first and give you a chance to fix the problem. We'll restore access once the issue is resolved.

14. Ending this agreement

  • By you. You can stop using the Service at any time. You can cancel your subscription (section 6) and delete your organization or account from its settings.
  • By us. We may end this agreement for an account or organization if you materially breach these terms and don't fix the breach within 14 days of our notice, or immediately for serious abuse, fraud or illegal use.
  • If we shut the Service down. We'll give at least 60 days' notice, let you export your data, and refund any prepaid fees for the unused part of your subscription.
  • After ending. Your right to use the Service stops. Sections that by their nature should continue (for example sections 8, 16 to 22) keep applying.

15. Deleting your data

  • Organization owners can delete an organization, and any user can delete their account, from the app's settings. Deletion is permanent.
  • After deletion, data is removed from our live systems within 30 days and from backups within 90 days, except where we must keep limited records by law (for example billing records).
  • If we end your account under section 14, we'll give you a reasonable chance to export your data first, unless the law or a serious security or abuse issue prevents it.

16. Intellectual property

  • We (and our licensors) own the Service, including its software, design, documentation and the TestLinkPro name and logo. These terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription (or while you use the Free plan), in line with these terms. All other rights are reserved.
  • You keep all rights in your Customer Data (section 8).

17. Feedback

If you send us ideas, suggestions or feedback, we may use them to improve TestLinkPro without any obligation to you. This doesn't give us any rights in your Customer Data.

18. Confidentiality

Each of us may receive non-public information from the other, such as your Customer Data or our non-public product plans. Each of us will keep the other's confidential information confidential, use it only for this agreement, and protect it with reasonable care. This doesn't apply to information that is public through no fault of the receiver, was already known to the receiver, was independently developed, or must be disclosed by law (with notice to the other party where allowed).

19. Warranties disclaimer

We will provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service is provided "as is" and "as available". We don't promise that it will be uninterrupted, error-free or completely secure, or that it will meet every one of your requirements. We make no other warranties, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement.

TestLinkPro helps you organize testing. It doesn't guarantee that your software is free of defects, and you remain responsible for your own release decisions.

20. Limitation of liability

To the extent the law allows:

  • Neither of us is liable for indirect or consequential losses, or for loss of profits, revenue, business, goodwill or data (other than our obligations to keep backups as described in our Privacy Policy), even if we were told they might happen.
  • Each party's total liability under these terms in any 12-month period is limited to the fees you paid for the Service in the 12 months before the event giving rise to the claim, or USD 100 if you were on the Free plan.
  • These limits don't apply to your payment obligations, to your liability under section 21 (Indemnity), or to liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.

If you are a consumer, nothing in these terms affects your mandatory legal rights.

21. Indemnity

You'll defend and compensate us (indemnify us) against claims, losses and reasonable costs (including reasonable legal fees) brought by third parties that arise from your Customer Data, your breach of the acceptable use rules in section 9, or your use of third-party tools or AI providers through the Service in breach of their terms. We'll tell you promptly about any such claim and let you control its defence, and you won't settle it in a way that admits fault on our behalf without our consent.

22. General

  • Changes to these terms. We may update these terms from time to time. For material changes, we'll give at least 30 days' notice by email or in the app before they take effect. If you don't agree, you can cancel before the change takes effect (and, for an annual plan, ask for a pro-rata refund of the unused period). Continuing to use the Service after that means you accept the new terms. The "Last updated" date shows the latest version.
  • Governing law. These terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction. If you are a consumer, you also keep any protection given by the mandatory laws of the country where you live, and you may bring a claim in your local courts.
  • Disputes. Before starting any legal claim, please contact us at hello@testlinkpro.com so we can try to fix the problem informally.
  • Transfer. You can't transfer this agreement without our consent. We may transfer it as part of a sale or reorganization of the business (for example, to a company set up to run TestLinkPro), and we'll tell you if we do.
  • Events outside our control. Neither of us is liable for delays or failures caused by events outside our reasonable control.
  • Whole agreement. These terms, together with the Privacy Policy, Refund Policy and any DPA or order terms we sign with you, are the whole agreement between us about the Service. If any part can't be enforced, the rest still applies. If we don't enforce a right straight away, we can still enforce it later.
  • Notices. We'll send notices to the email address of your account or organization owner. Send notices to us at hello@testlinkpro.com.
